The American Civil Liberties Union, the ACLU of Virginia, Lambda Legal, and the law firm Jenner and Block represent a class of all same-sex couples in Virginia, which was certified in a case called Harris v. Rainey, and that class is now part of the Bostic v. Schaefer case, which will be argued on Tuesday. A federal judge struck down the ban in February in Bostic, which was brought by two couples in Norfolk who were represented by attorneys Ted Olson and David Boies.
